    The role that Paul Scholten assigns to conscience in his legal methodology still leads to heated discussions in literature after almost 100 years. Recognizing that in case law the conscience of the judge can be of decisive importance is apparently problematic. It would facilitate political court rulings, make judicial judgment uncontrollable and could be arbitrary for the parties to the legal dispute. Not only Scholten’s view on the role of conscience in judicial decision making is “a stumbling block”. At least as great is the fuss about his representation of conscience. Only Christian lawyers could identify with this. This article attempts to shed new light on the above points of criticism by drawing attention to the following aspects of Scholten’s legal methodology: the role of the facts in establishing the law, the nature of the legal judgment and finally the grounds on which conscience may be determined.

    In this article we elaborate on the place of religion in the workplace. Does the individual freedom of religion imply that employers must always accommodate the religious claims of employees or can they boast a number of arguments allowing them to legitimately limit that freedom? And, conversely, do employers not also have a right to freedom of religion and a right to formulate certain religious expectations for their employees? In this contribution, we deal with these and related questions from a legal-philosophical perspective. The overall aim is to illustrate the extent to which univocal answers are jeopardized because of conceptual ambiguities. We first make a normative distinction between two strategies (i.e. difference-blind approach and difference-sensitive approach) and subsequently illustrate and elaborate on how and why these strategies can lead to different outcomes in legal cases. We illustrate the extent to which a contextual and proportional analysis can be a way out in theoretical and practical conundrums.

    De Vereeniging voor Wijsbegeerte des Rechts (VWR) is opgericht op 28 december 1918. Zij had tot doel de studie van de rechtsfilosofie en het maatschappelijk leven. Deze studie moest tevens relevant zijn voor de rechtspraktijk. Vanaf haar oprichting kende de VWR een sterke internationale oriëntatie, aanvankelijk gericht op Duitsland, later vooral op het Verenigd Koninkrijk en de VS. In de jaren zeventig en tachtig van de vorige eeuw beleefde de VWR wat betreft belangstelling en ledenaantal haar hoogtepunt. In 2016 besloot zij – na een gestage neergang – de band met de Nederlandstalige (praktijk)jurist weer aan te halen.

Abstract

    In deze bijdrage staat de activiteit van bewijzen in strafzaken centraal. Betoogd wordt dat de vigerende rationalistische opvatting van strafrechtelijk bewijzen eraan voorbij gaat dat het bewijzen zich allereerst voltrekt op een vóór-reflectief niveau. Het primaire blikveld van de mens is namelijk niet het objectiverende kennen, zoals in de rationele bewijstheorieën wordt voorondersteld, maar de praktische relatie tot de wereld. In dit kader wordt eerst de filosofische achtergrond van de rationalistische bewijsopvatting in kaart gebracht, in het bijzonder de invloed van Aristoteles en Descartes. Vervolgens worden de daaruit voortkomende bevindingen aan de hand van ideeën en inzichten die zijn ontleend aan de existentiële fenomenologie kritisch gewaardeerd. Dit leidt tot de uiteenzetting van een hermeneutische opvatting van strafrechtelijk bewijzen.

    Een bekend kenmerk van Scholtens beschouwingswijze was zijn dialectiek.
    Langemeijer heeft de aard ervan scherp geduid, maar erkend in het duister te tasten over haar oorsprong en bronnen. Hegel en Barth komen niet in aanmerking. Ik wijs op de betekenis die de theoloog P.D. Chantepie de la Saussaye (1848-1920) gehad kan hebben voor de ontwikkeling van Scholtens denken, zowel inhoudelijk als qua dialectiek. Sommige contemporaine auteurs lijken Scholten schatplichtig te achten aan Kierkegaard; ik acht dat te speculatief. Moderne digitale technologie opent potentieel grote mogelijkheden voor de toepassing van computers en artificiële intelligentie (AI) in de rechtspleging. Scholtens dialectiek stelt ons voor fundamentele rechtsfilosofische vragen ten aanzien van de mogelijkheid en wenselijkheid van ‘rechtspraak door computers’.

    The central question in this article is whether an empirical-legal approach of victimhood and victim rights could offer a sufficient basis for proposals of legal reform of the legal system. In this article, we choose a normative-critical approach and raise some objections to the way in which part of such research is currently taking place in the Netherlands, on the basis of two examples of research in this field, one dealing with compelled apologies as a possible remedy within civil procedural law and the other with the victim’s right to be heard within the criminal legal procedure. In both cases, we argue, the strong focus on the measurable needs of victims can lead to a relatively instrumental view of the legal system. The legal system must then increasingly be tailored to the wishes and needs of victims. Within this legal-empirical, victim-oriented approach, there is little regard for the general normative principles of our present legal system, in which an equal and respectful treatment of each human being as a free and responsible legal subject is a central value. We argue that results of empirical-legal research should not too easily or too quickly be translated into proposals for legal reform, but first become part of a hermeneutical discussion about norms and legal principles, specific to the normative quality of legal science itself.

    The presumption of innocence (PoI) is considered to be an important principle for regulating pre-trial detention. The idea is that pre-trial detention should be a last resort. However, pre-trial detention practice demonstrates that pre-trial detention does not function on the basis of a presumption of innocence but rather from a presumption of guilt and dangerousness. It must be concluded that, with regard to pre-trial detention, the PoI has a rather limited normative effect.

    This article examines how a liberal public morality can be most successfully defended against perfectionism. First of all the five most important liberal arguments for freedom are taken from what is called the liberal canon: a number of characteristic works of John Locke, Immanuel Kant, John Stuart Mill, Isaiah Berlin, Joseph Raz, Ronald Dworkin, and John Rawls. These five arguments are identified as: social and political realism, respect for autonomy, fallibility of ideas, pluralism, and respect for reasonableness. Next, the persuasiveness of these arguments is assessed, starting with the argument of respect for reasonableness, which is at the heart of Rawls’s political liberalism. It is concluded that in itself this argument is not strong enough to persuade perfectionists. A powerful defence of a liberal public morality needs the other arguments for freedom as well. Finally, the paper outlines how these other arguments can strengthen the argument of respect for reasonableness in a coherent manner.

    In her book Eichmann in Jerusalem Hannah Arendt concluded that the Eichmann trial taught us the lesson of the ‘fearsome, word-and-thought-defying banality of evil’. Arendt explained the concept of banality as thoughtlessness: Eichmann did not realize what he was doing when he planned and executed the Final Solution of the Jewish Question in Nazi Germany. In this article Arendt’s analysis of Eichmann’s evil is criticized from an internal perspective: the conclusion that Eichmann was thoughtless cannot be founded on the information Arendt herself gives, especially her reports on Eichmann’s idealism, his knowledge of Kant’s categorical imperative, his Pontius Pilate feeling during the Wannsee Conference, and the two crises of conscience Eichmann experienced during the Holocaust. This information shows that Eichmann clearly realized what he was doing in a moral sense and consciously decided to go on with the Final Solution on the basis of his own convictions as a Nazi.

    There are two fundamental problems with regard to the freedom of religion. The first concerns the content and scope of the right; the second, a possible unequal treatment between population groups. The first problem can only be dealt with by a preliminary analysis of the religious phenomenon, which precedes a legal definition. It turns out that there is a range of different types of religion, with on the one hand traditional forms of religion which are narrowly interwoven with the culture in question (all kinds of ‘cultural’ practices possessing a religious dimension), and on the other forms of religion which loosen to a considerable extent the ties between culture and religion. Evidently, the former types of religion cause problems in modern society. An additional problem is that freedom of religion as a modern basic right rests on a view of human being – including the idea of the inherent dignity and autonomy of the human person – which is at odds with the symbolic universe of traditional religion. The conclusion of the article is that in the modern pluralist society freedom of religion is on its way to becoming, or already has become, an unmanageable right. So the problems arising around this right (including that of unequal treatment) can only be solved in a pragmatic, not really satisfactory way. In that context, modern humanitarian standards should be observed in the implementation of the right of freedom of religion because fundamental human rights are connected with a specific concept of humanity.

    The legal scholars Paul Scholten (1875-1946) and Herman Dooyeweerd (1894-1977) had much in common. The most significant agreement is their emphasis on the influence of a (religious) worldview on legal scholarship and practice. Unfortunately, they never met to discuss the similarities and differences of their jurisprudential ideas. In this article I try to reconstruct this conversation which never took place. Scholten’s legal thought is specifically oriented to the practice and difficulties of judging. Dooyeweerd above all was a philosopher whose specific philosophy of the modal aspects of reality is the basis for his thinking about the law. Both scholars emphasized the importance of legal principles. They also identified several fundamental legal categories and concepts. However, their methodology is different. The way religion and morality influence their legal thought is also different. A discussion of the contemporary relevance of their work completes the paper.

    In light of the possibility that Belgium could fall apart in coming years this contribution argues that it is time to reflect on a constitution for Flanders: What are the characteristics of a good constitution? A good constitution would entrench fundamental freedoms, which are historically rooted in society. Moreover, it obliges the government to maintain and enforce the laws, preventing abuse of power and corruption. Finally, a functioning constitution stands above temporary interests of partisan politics, and should not be used as a means to encumber future generations with our ideological choices.
